Rescission Timeframes
This page is designed to provide a general understanding of the timeframes for rescinding (canceling) a timeshare agreement based on state regulations. It is not a substitute for legal advice. Before taking any action, you should consult with a licensed attorney for guidance specific to your situation.
You can rescind (or cancel) a timeshare agreement without cause and without penalty within a certain timeframe. A buyer’s right to rescind is generally non-waivable. In most cases, it must be clearly stated, emphasized, and effectively communicated within the contract to adhere to various state regulations. Additionally, many states mandate that certain disclosures, including the right to rescind, be provided at the time of purchase or shortly thereafter.
The time you have to cancel the contract varies by state, ranging from 3 to 15 days. In states without specific timeshare laws, regulations may fall under consumer protection, real property, or solicitation laws. In such cases, we recommend consulting with an experienced timeshare attorney to ensure that your case is handled properly.
If the deadline to cancel your contract has passed, don’t lose hope, as other options are still available. At the Aaronson Law Firm, our team of attorneys and support staff are exclusively dedicated to assisting clients with timeshare contract cancellations.
